Alice Cohen and Ronald Cohen, a married couple living in Gilford, New Hampshire, filed a lawsuit against Eataly Boston for at least $50,000 after Alice allegedly slipped and fell on a piece of prosciutto while walking over to an area where free samples were being offered on Oct. 7, 2022, according to court documents.
According to the suit: Alice's left ankle was fractured because of the smoked ham incident and she experienced "great pain and suffering," lost enjoyment of life, and was faced with medical expenses because of the injury.
Eataly failed to ensure its floors were safe for patrons by not removing potentially dangerous conditions and not warning Alice that there was a hazard.
Ronald is also suing Eataly for loss of consortium, a term that includes companionship, comfort, support, and intimate relations, according to Bradley Law Personal Injury Lawyers.
Eataly has until Dec. 11, 2023, to respond to the complaint, according to Universal Hub.
